Partner program terms

These terms are between you and Attravo Commerce LLC, a Florida limited liability company with its registered office at 66 W Flagler Street, Suite 900, Miami, FL 33130, USA (“Attravo”, “we”, “us”). They govern Attravo Partners (the “Program”), in which you recommend our Shopify apps (Cart Drawer Upsell, Bundles & Quantity Breaks, Product Quiz Maker and Post Purchase Upsell) and earn commission on what the stores you refer pay us.

You accept these terms when you apply. If you apply for a company, you confirm you can bind it, and “you” means that company. Our terms of service, privacy policy and acceptable use policy also apply. Where they disagree with these terms about the Program, these terms win.

The Program is for agencies, developers, consultants, creators and store owners who work with Shopify merchants. To join you must be at least 18, able to enter a contract where you live, and not barred from receiving payments from a US company.

We review every application and may approve or decline it at our discretion, without giving a reason. Approval assigns you a plan, which sets your commission rate and how long it lasts. You may hold one partner account per person or company.

Your partner portal at partners.attravo.com holds your links, your code, the stores you refer, your commission and your payouts. Keep your details accurate and your login to yourself. You are responsible for everything done through your account.

A Shopify store is credited to you for one of our apps when either of these happens:

• It installs the app within 60 days of the merchant giving their store on your referral link.
• You claim it in your portal with how you brought it in, and we accept the claim after checking it.

The first valid referral wins: a store already credited to another partner for an app stays with them. A store is not credited for an app it already had installed before your referral, for a store you or your company own or control, or for a test, development or staff store.

Once a store makes its first payment for the app, the credit is locked to you for as long as the commission lasts. Our records, including the data Shopify gives us, decide whether and when a store was referred, installed and paid.

You earn a share of what Shopify pays us for each store credited to you, for each charge: recurring subscription, usage and one-time charges alike. The share is set by your plan; the standard plan is 20% for as long as the store keeps paying for the app.

Commission is calculated on our net revenue from the store: what Shopify actually pays us after its own revenue share, fees and taxes. It does not apply to free plans or to anything a store doesn’t pay for. Commission stops when the store stops paying, uninstalls the app, or when your plan’s period ends.

We may change plans and rates for new referrals with 30 days’ notice by email. Commission you have already earned keeps the rate it was earned at.

Each commission is held for 30 days after the store’s payment, so refunds and chargebacks can come off first. If a store is refunded, credited or charged back, the commission on that amount is reversed. If it was already paid to you, we deduct it from your future commission.

We may hold commission longer while we review a referral that looks unusual, such as a refund soon after the first payment or a store connected to you. We release it when the review is done, or reverse it if the referral breaks these terms.

We pay monthly, once your balance of commission past its hold reaches US$50. Balances below that carry over to the next month. Payouts are in US dollars by local bank transfer or international wire to the bank account in your portal.

You are responsible for the bank details you give us. Fees charged by your bank or intermediary banks, and currency conversion, are yours. If a payout is returned because of wrong details, we send it again once you correct them. We don’t pay to anyone other than the partner on the account.

You are responsible for reporting and paying the taxes on what you earn. We may ask for a tax form, such as a W-9 or W-8BEN, before paying you, and we may withhold tax where the law requires it.

Say clearly, wherever you recommend the apps, that you earn a commission if people sign up through you. In the United States this is required by the FTC’s endorsement guides, and similar rules apply elsewhere. Describe the apps honestly, and don’t promise features, prices, discounts or results we don’t offer.

You may not:

• Bid on Attravo, our app names or their misspellings in paid search, or use them in domain names, social handles or ad copy that could pass as ours.
• Present yourself as Attravo, or as our staff, support or official reseller.
• Send spam, or promote the apps in ways that break Shopify’s rules or the law.
• Offer money, discounts or anything else in return for installs or App Store reviews, or write or buy reviews of the apps.
• Use cookie stuffing, forced clicks, hidden links, bots or any other way of collecting credit for stores you didn’t refer.
• Refer stores you or your company own or control.

While you are an approved partner, you and the stores you refer get priority support: your requests are handled ahead of the general queue, by the team that builds the apps.

Stores you refer can also have their setup moved to our apps from a comparable cart, bundle, quiz or post-purchase app at no charge. We agree the scope of each migration with the store first, and may decline one that goes beyond setting up our app.

These benefits are part of the Program, not a paid service. We may change them with notice on the partners page.

We give you a limited, revocable, non-exclusive right to use the Attravo name, our app names, logos and the materials we provide, only to promote the apps under these terms and as we provide them. Don’t change them or combine them with your own brand in a way that suggests a closer relationship than this one. We may ask you to change or remove any material that uses them, and you agree to do so promptly.

Your portal shows the stores credited to you by address, the apps they use through you, and what they pay. Use this only to support those merchants and track your commission. Don’t sell it, share it, or use it to contact merchants who haven’t asked to hear from you.

You are responsible for handling any personal data you collect yourself in line with the privacy laws that apply to you. How we handle your own data is set out in our privacy policy.

You join as an independent contractor. Nothing in these terms makes you our employee, agent, partner in law or joint venturer, and you can’t make commitments for us. The Program is not exclusive: you may promote other apps, and we may work with other partners, including ones in your market.

You can leave the Program at any time by writing to support@attravo.io. We can end your participation, or the Program, with 30 days’ notice by email.

If you leave, or we end it without cause, commission you have earned up to the end date is paid in the following payouts once it passes its hold, even if your balance is under US$50. Commission on payments after the end date stops.

If you break these terms, we may suspend your account at once while we look into it, and end your participation without notice. Commission from referrals that broke these terms is forfeited, and we may recover any of it already paid.

The Program, the portal and the apps are provided as they are. To the fullest extent the law allows, neither of us is liable to the other for indirect or consequential losses, or for lost profits, revenue or data, arising from the Program. Our total liability to you under these terms is limited to the commission we paid you in the 12 months before the claim. Nothing here limits liability that the law does not allow to be limited.

These terms are governed by the laws of the State of Florida, USA. Disputes are resolved as set out in the governing law and disputes section of our terms of service.

We may update these terms. We tell partners about material changes by email at least 30 days before they take effect, and the date at the top of this page changes. If you keep taking part after that, the new terms apply. Commission already earned keeps the terms it was earned under.
